Zagreb court will rule on Mamic’s application to serve time in Bosnia in 10 days

Zagreb County Court has received an application from former football coach Zoran Mamic, who has asked to serve his prison sentence of four years and eight months in Bosnia and Herzegovina after he was convicted in Croatia for siphoning money from the Dinamo football club, the court said on Tuesday.

Mamic sent the application from neighbouring Bosnia and Herzegovina via his defence attorney. Mamic’s brother Zdravko Mamić was convicted to six and a half years in prison for siphoning 116 million kuna (€15 million) from the Dinamo football club. Just before the conviction was delivered, Zdravko Mamic fled to Bosnia and Herzegovina, where he has been for the past three years.

Zagreb County Court spokesman Kresimir Devcic told state agency Hina on Tuesday that Mamic’s application “would be examined and a decision would be made on whether Bosnia would be asked to take over his case, and for Mamic to serve his time in that country.”

That decision should be known in about ten days.

If a decision is made that there are no grounds for Bosnia to take over the case,  the procedure will continue in line with Croatian legislation. If the application is approved, a request to that effect will be sent to Bosnia’s judiciary.

Asked whether Mamic’s departure to Bosnia could have been prevented by issuing “precautionary measures” against him, Devcic said that “each case is treated individually.”

Zoran Mamic’s departure to Bosnia and Herzegovina and the issue of whether the court should have imposed “precautionary measures” to prevent it and whether grounds for that exist at all has caused heated debates between the Ministry of Justice and the Supreme Court.

In a statement sent to the press on Monday, Mamic said that he was not on the run but was using his legal rights to which he was entitled under agreements between the two countries and his dual citizenship. He added that he had informed Zagreb County Court, that he wished to serve his sentence in Bosnia.

His brother Zdravko had previously applied to serve his sentence in Bosnia, where he fled in June 2018, just prior to the announcement of the verdict by Osijek County Court.
